Advice for newly separated Australian mothers
04.02.08 (9:04 pm)   [edit]

I don't know how many Australian readers I have, probably not many, but just in case:  if you've just recently separated, have any children under 18, & their father isn't paying any child support, then immediately contact the Child Support Agency to organise child support through them!

It'll take about an hour over the 'phone:  131 272.  You'll need to provide your tax file number, Centrelink Reference Number (if you have one), your taxable income for the last financial year (& his), full contact details for both of you, names & dates of birth for the children, & tell them how many nights your children will be staying with him for the next 12 months (I know, you're expected to foresee this), etc etc - however before you commit to giving them a number of nights, find out what the tiers are, eg after 1st July 2008:  0-51 nights is called Nil; 52-127 nights=regular; 176-189=shared; 190-237=shared(?); 238-313=primary; 314-365=sole care (or so I was told after probing today).  Obviously nil or regular will result in more child support for you, than higher tiers, at least in theory.

I didn't entirely panic when my husband, through his solicitor (lawyer) refused to pay child support & spousal maintenance, because I was under the impression that the CSA would pay 'back pay' - but when I finally contacted the CSA today I discovered that they don't!  I have missed out on perhaps several thousand dollars because I was not aware of this!  That's money I need to put food on the table.  :-(

Please benefit from my experience.

It is terrible that he refused to pay, most men have to be forced to step up to the plate and do right. praying for you and the kids.

I can't believe they don't backtrack when payments are missed! We do that even in Texas. Furthermore, I'm always baffled and outraged when fathers refuse to take responsibility for their children.

You're in my prayers.

Thank-you Mimi, although in my ex's defence: he does have the children to stay over sometimes, & does pay for some of their needs.

He hadn't actually started paying any child support officially, although I did have some access to joint funds by default until mid January, when he stopped the deposits into that account. It's not that he's not taking responsibility for his children so much (although of course I am feeding them for over half the time), but that he expects me to suddenly go out & work full time to support myself, which is something I haven't done since early 1989, & I'm not the young energetic healthy recently experienced woman I was back then, now.
